Car Dealers Trying It On Again!

Auto Express recently carried a story, explaining how Stephen Larkin from Newcastle ordered a Skoda in March and was told that delivery would be delivered by early July at the latest. After passing this date he decided to cancel the order and wrote to the dealer saying he wanted to cancel the order as they hadn’t delivered the car and asked for his £1,000 deposit back. He sent numerous letters and calls to the dealer without joy along with no help from Skoda, all they said was that it was down to the customer going through the terms of the contract when he placed the order. Excuse my language but what a load of bullshit! First of all the dealer is in breach of contract and not only should he refund the deposit immediately but pay compensation to Mr Larkin. Whilst the delivery may have been obscure, expressed as ‘early July at the latest’ a court would accept the 15th of the month as being the latest delivery date. You can make the date specific by stating in a letter that you require delivery by a certain date, say 1 week after the rough date given, stating that you are ‘making time of the essence’. I appreciate that Auto Express is trying to help but everyone seems to guess when it comes to these sorts of issues. In addition, as I have stated to the point of tedium, always, always pay your deposit to a dealer with a credit card, that way you are covered for the full value of the car if the dealer goes bust, you can claim a refund from the credit card company and in the worst case you can take matters up with the Financial Ombudsman Service.
