A Speeding Fine That Was Thrown Out

Tuesday, 1. December 2009

In an interesting speeding case a van driver has had his case thrown out after being charged for driving at 61mph in a 50mph restricted area. Gareth Powell was clocked on the A4174 near Bristol in November last year when working as an employee of MD Building Services. However, his van was fitted with Navman  wireless tracking and when Navman Wireless checked the records they found that Mr Powell was only travelling at 48mph and within the speed limit. As a result of the proof from Navman Mr Powell contested the prosecution and won. The case was dismissed by the District Judge at Bath and Wansdyke Magistrates Court. Lesson to be learned there and a case for fitting wireless tracking devices on company vehicles as Mr Powell may have lost his job if convicted of speeding. By Graham Hill
